The presence of a police officer didn’t stop two men from reportedly acting up at a Madisonville restaurant and getting arrested Oct. 10.
Madisonville Police Officer Wes Martin said he was eating his breakfast at the Waffle House on Highway 411 around 3:40 a.m. when two men on the opposite side of the restaurant began to whistle loudly and yell, causing a disturbance.
Martin said he waited a brief period of time, then stood up to announce his presence, told the men to calm down, then sat back down to his breakfast.
Martin said the two men soon began to yell and whistle again, causing another disturbance. Martin said he walked over to the men and told them again to calm down. He then walked back to his own seat, but one of the men, later identified as Carlos Gaena, began yelling at Martin, being argumentative.
Martin said he asked the men a third time to calm down, but Gaena began to talk louder and Martin said he could smell alcohol coming from Gaena and his eyes were extremely red.
Martin said it appeared obvious Gaena was under the influence and he placed him under arrest. The other man, Rodriguez Escobar, also smelled of alcohol and appeared to be under the influence, was unsteady on his feet and had slurred speech. He too was placed under arrest.
Both Escobar, 37, Steer Creek Road, Tellico Plains, and Gaona, 37, Rafter Road, Tellico Plains, were charged with disorderly conduct and public intoxication.
